A 24-year-old woman convicted nearly four years ago of homicide by drunken driving could face more time in prison after she was charged Wednesday with possession of heroin.
But Lindsay J. Rice, of Baraboo, has been cooperating with investigators looking into a heroin distribution ring that appears to center around a Fort Atkinson man, according to court documents.
Rice was convicted in the drunken driving death of Matt White, 23, who died May 20, 2003, when Rice slammed her car into a tree at high speed at Nakoma Road and Midvale Boulevard. She was sentenced to 14 months in prison to be followed by nearly nine years of extended supervision.
At the time he sentenced Rice, Dane County Circuit Judge James Martin said he was impressed by the strides that she had made in treatment, work and school since the crash. A criminal complaint filed Wednesday, however, indicated that on Feb. 25, before Rice was arrested at a Middleton motel room, she had used her Edgewood College identification card to "cut" heroin so that it could be snorted.
Rice has been in the Dane County Jail for a possible violation of extended supervision since her arrest. She could face resentencing on the drunken driving homicide conviction, but no determination has been made about whether to seek revocation of her supervision, state Department of Corrections spokesman John Dipko said.
The day Rice was arrested, according to a search warrant filed Wednesday, she offered to cooperate with investigators and made phone calls in the presence of police to alleged heroin source Don Harden, 38, of Fort Atkinson, that led to his arrest the same day outside Visions night club in Madison.
Harden was charged on March 4 with conspiracy to deliver more than 50 grams of heroin. He remains in the Dane County Jail.
According to the search warrant, Harden had been supplying heroin to another person to sell, and that person is an associate of Rice and her boyfriend. All had bought heroin from Harden in the past. After Rice was arrested, she offered to cooperate with the investigation, the search warrant states.
The complaint against Rice indicates that after her arrest, police searched her room at the Comfort Suites in Middleton and found heroin and drug paraphernalia, along with Rice's Edgewood ID card, which she said she had been using to cut heroin into lines.
